This Policy applies to purchases through Disty websites, applications and authorised sales channels. It shall be read together with the Terms and Conditions for Using the Disty Platform and the Privacy Policy. Mandatory statutory provisions shall prevail, followed by a valid specific agreement and the details of the accepted Order, in accordance with the order of precedence in the Terms. Subsequent amendments shall not apply retrospectively to an accepted Order without valid agreement or a legal requirement. The Seller is the party identified before contracting and in the sales documents, whether Disty or an independent Marketplace Seller. Disty shall receive and follow up return requests in accordance with its role, without prejudice to each party’s obligations and statutory liability.
Cancellation may be requested before dispatch without a fee, except to the extent a valid agreement is permitted for made-to-specification products or special contracts under Section 5.7 of the Terms. Merely describing goods as imported or specially sourced does not remove a statutory right. Once dispatch has begun, the applicable return or cancellation provisions shall govern the request.
Subject to statutory exceptions, a Customer entitled to cancel under Article 13 of the E-Commerce Law may notify us of cancellation during the seven days following receipt of the product, provided that it has not been used and no benefit has been obtained from it. The period is calculated in calendar days. Any longer return benefit agreed or advertised for the Order shall apply. For purchases for resale and other transactions, the scope of the right shall be determined by the nature of the transaction, the contract and applicable law. A mandatory right shall not be extinguished merely because the account is registered as a business.
The product shall be returned with its parts, accessories, gifts and associated documents, retaining its packaging and seals to the extent necessary and lawful to verify its condition and that it is unused. Opening the packaging alone does not automatically extinguish a mandatory right. Activation or use shall be assessed by reference to the product’s nature, the benefit actually obtained and the statutory exception concerned. Original packaging is not an absolute condition for addressing a defect or non-conformity.
The exceptions provided by applicable law and regulations shall apply according to the nature of the goods or services, including products manufactured to the Customer’s order or specifications, used software and certain digital products, and products whose defects arose from the Customer’s mishandling. Product-specific restrictions shall be disclosed before contracting. A description such as “final sale”, “opened electronics” or “hygiene product” is not, of itself, a general exception: the conditions of the applicable statutory exception must be satisfied. Rights concerning defects, counterfeiting and non-conformity remain protected.
Notify us upon discovering a product that is defective, counterfeit, inconsistent with the specifications, damaged before delivery or incomplete. Reporting visible damage, shortages or supply errors within 48 hours is requested to facilitate investigation. This is a procedural period that does not automatically extinguish statutory rights or restrict hidden-defect or warranty claims. Photographs, video, a written description and other available evidence may be provided. An unboxing video is not required for every claim to be accepted.
Submit the request through support, the account manager or an authorised written channel, identifying the purchase reference, product, quantity, reason and remedy sought. We shall explain the return method and address or collection arrangements, as appropriate. Do not send the product to an unconfirmed address or a personal account. Retain the request reference and proof of handover of the return, and package it appropriately. The reference number is a tracking aid; an internal delay in issuing it does not invalidate a properly submitted notification.
The product shall be inspected within a reasonable period having regard to its nature, and the Customer informed of the outcome and reasons for any rejection. The remedy shall be repair, replacement, making good a shortage, cancellation or a price reduction according to the right applicable. A remedy inferior to the Customer’s entitlement shall not be imposed without valid agreement. The responsible party shall bear the costs of remedying its error, including necessary collection and replacement supply. For a change-of-mind return, the Customer shall bear only lawful, disclosed costs, without a general restocking fee that was not agreed.
An exchange is subject to the availability of a suitable replacement and the Customer’s agreement to any disclosed difference in specifications or price. A replacement product shall not be imposed where a refund is due. Amounts, tax and credit-purchase invoices shall be handled under the Refund Policy. Returning a product shall not require the Customer to accept Wallet credit instead of a refund to which it is entitled.
